Legal Basis for Used Software Trade in the EU

Key Points:

  • EU Law:
    • The EU has a uniform law on copyright that establishes the principle of exhaustion of rights. This means that once a software producer sells a copy of their software, they lose the right to control further distribution of that specific copy.
    • This principle applies to both physical copies (e.g., CDs, DVDs) and digital downloads.
    • The resale of used software licenses, including online transfers, is generally permitted within the EU.
    • Second-hand buyers have the right to updates and patches, as long as these are necessary for the software to function.
  • International Law:
    • The WIPO Copyright Treaty provides an international framework for copyright protection, including computer programs.
    • It also addresses the principle of exhaustion of rights, but with some limitations and exceptions.

In essence, the EU legal framework allows for the legitimate trade of used software licenses, ensuring a fair balance between the rights of software producers and consumers.
